Gulf Shores adopts ordinance changing how newly annexed land is initially zoned

The Gulf Shores City Council on Feb. 9 adopted Ordinance No. 2199, a zoning text amendment (ZTA25-09) that revises procedures for zoning land newly annexed into the city.
Planning and Zoning Director Scott Stephens presented the amendment during a noticed public hearing and summarized changes to Article 3 (Administration). Among the revisions, the ordinance references the pre-zoning process in Code of Alabama § 11-52-85 and directs that properties with an existing single-family principal use be initially zoned in categories (R-1-1 through R-1-4) that most closely correspond to adjacent properties and minimum lot areas in Table 7-1B unless the pre-zoning process is followed. The ordinance also states that newly annexed land generally shall be immediately placed into the R-1-4 District except for certain county zoning conversions listed in Table 3-9.
The ordinance includes provisions specifying how lands annexed from Baldwin County zoning districts 25 and 30 map to comparable city zoning classifications and makes other procedural updates, including honoring development approvals in place prior to annexation. The Planning Commission heard the request Dec. 16, 2025, and recommended the amendment following a public hearing.
Council members voted unanimously to suspend the rules and adopt Ordinance No. 2199; no public objections were recorded at the hearing.
Next steps: The ordinance is effective immediately after adoption and publication as required by law. Planning staff will apply the new procedures to future annexation requests and pre-zoning petitions.
