County attorney reports appellate rulings; manager outlines road work, election and trash fee changes

County Attorney Bin Minter told the commission that the Court of Appeals recently issued two opinions with direct effect on county litigation. In UGOCCC v. Damon Hoyte (Superior Court Case No. 23CV072) the Court of Appeals reversed the Superior Court and reinstated the magistrate court's prior ruling on Mr. Hoyte's zoning matter. Separately, in Haymond v. Hoyte the Court of Appeals vacated the Superior Court's denial of a motion to dismiss and remanded the matter; motions remain pending in Superior Court. County Manager Thomas Weaver provided operational updates. He said Friendship Road resurfacing is scheduled to begin Dec. 1, 2025, with a cost estimate of $106,000 and that preconstruction took place Oct. 1. Weaver said rough spots on Manta Road will be repaired before resurfacing. He reminded residents that early voting for the local FLOST question begins Oct. 14 and Election Day is Nov. 4 at the recreation center.
At the Oct. 27 work session Weaver reported that solid‑waste hauler GFL raised residential collection rates by $2.00 and that an extra container now costs $14.00 per month; the county plans to reflect that increase on January water bills rather than absorb the cost. Weaver also reported a denial of a TAP/T grant application due to right‑of‑way access issues and public‑works activity including grader work on Patterson Road and completion of a storage slab at 215 McNaughton Street.
Chairman Charles Coffey also asked the county attorney to prepare a press release in response to a newspaper article he described as inaccurate; the minutes quote Coffey asking staff to coordinate a response so “the public know the truth.”
