Cusseta‑Chattahoochee County adopts ordinance to regulate public cemeteries

The Commission of the Unified Government of Cusseta‑Chattahoochee County on Oct. 7 approved Ordinance No. 2025‑1, establishing rules for the operation, sale and maintenance of the Harmony Public Cemetery.
The ordinance text included in the packet would add Article III—CEMETERIES to Chapter 20 of the county code and covers definitions (including ‘‘plot’’ and ‘‘interment’’), superintendent duties, recordkeeping, sale and transfer of lots, interment/disinterment procedures, marker and monument standards, maintenance responsibilities, fines of up to $500 per offense and civil enforcement. The ordinance identifies Map C04‑Parcel 0054 (101 Sparks St.) in its preamble.
County Attorney Bin Minter briefed the commission on the legal basis for the rules, and a motion to approve the ordinance was made and seconded during the Oct. 7 meeting; the minutes record a unanimous vote. The ordinance text in the packet also lists a first reading on Aug. 25, a second reading on Sept. 2 and a public hearing on Sept. 22, 2025.
The ordinance grants enforcement authority to the County Manager and the UGOCCC Code Enforcement Department and states it takes effect immediately upon adoption unless specified otherwise. Penalties for violations are set in the ordinance and the county reserves the right to deny future burial services for repeat or egregious violations.
The commission did not record separate amendments to the ordinance in the Oct. 7 minutes. The measure was entered into the record and will be enforced by the office of the County Manager and Code Enforcement as provided in the ordinance.
