The Buffalo County Board of Commissioners on April 11 approved a Vacation Application to vacate part of 1st Avenue (Raasch Subdivision) and separately approved a zoning map amendment to rezone approximately 0.133 acres from Agricultural‑Residential (AGR) to Commercial (C) for property associated with 10075 First Avenue, L.L.C.
Mitch Humphrey, the licensed land surveyor representing applicant Brad Wegner (Trustee of 10075 First Avenue, L.L.C.), reviewed the vacation and rezoning requests during public hearings. No members of the public spoke. The Board closed both hearings and approved Resolution 2023‑17 (vacation) on a motion by Timothy Higgins, seconded by Ronald Loeffelholz, and Resolution 2023‑18 (rezoning) on a motion by Daniel Lynch, seconded by Bill Maendele; roll call votes were unanimous (Aye by all commissioners present on each item).
Key details recorded in the resolutions: the vacated tract will be united with the tract located at 10075 1st Avenue (tax parcel ID 560006017); officials found no public utilities occupying the land to be vacated; Planning and Zoning Commission had recommended approval (8‑0 with one absent). The rezoning resolution notes the change is consistent with the county’s Comprehensive Plan and that no protests were filed.
Next steps: both resolutions will be filed with the Buffalo County Register of Deeds and the County Clerk will amend the Buffalo County Zoning District Map accordingly.
