The Buffalo County Board of Commissioners approved a Development Restriction Agreement and authorized the Chairperson to sign documents related to a Letter of Map Revision based on fill (LOMR-F) for property in Bruner Lakeside Estates Second at its Sept. 24 meeting.
Resolution 2024-47 records that Buffalo County adopted floodplain regulations in 1986 and that the LOMR-F application and accompanying engineer certifications fulfill the local standards and findings required by the Federal Emergency Management Agency for the applicant seeking a LOMR-F. The board found it prudent to enter into a Development Restriction Agreement to govern future development on the subject property and authorized execution of the agreement after review by the County Attorney's Office.
The resolution identifies the property as Lot 11, Block 1, Bruner Lakeside Estates Second and states the Chairperson is authorized to execute the Development Restriction Agreement and that a copy of the resolution will be filed with the agreement against the subject property. The motion passed by roll call vote.
The minutes indicate the local floodplain administrator reviewed the LOMR-F request and that the board's action is intended to align county records with FEMA-level map revisions and local development restrictions.
