Buffalo County commissioners deny Heritage Hills subdivision final plat

The Buffalo County Board of Commissioners voted unanimously Oct. 22 to deny the proposed final plat for Heritage Hills Subdivision; the board advised applicants to submit any noncompliant plat to the County Board of Adjustment.
The Buffalo County Board of Commissioners voted 6-0 Oct. 22 to deny the proposed final plat for Heritage Hills Subdivision after Zoning Administrator Dennise Daniels presented a Summary Report of Denial. Vice Chairperson Sherry L. Morrow presided over the meeting in the Buffalo County Board Room.
Dennise Daniels told the board the application did not meet required standards outlined in the zoning summary report. Mitch Humphrey, the applicants' licensed land surveyor, addressed the board on behalf of the property owners and commented on the report but did not prevent the motion from moving forward. Ronald Loeffelholz moved to deny the final plat; Daniel Lynch seconded the motion.
The board recorded the following votes in favor: Ronald Loeffelholz, Daniel Lynch, Timothy Higgins, Myron Kouba, Bill Maendele and Sherry Morrow. Commissioner Ivan Klein was absent. The denial also included a recommendation that applicants seeking to advance a noncompliant plat must submit a written request to the Buffalo County Board of Adjustment for further consideration.
The denial ends county-level approval of the proposed plat but leaves the applicants the option to pursue relief through the Board of Adjustment if they wish to revise or appeal the decision. The county minutes do not specify additional technical fixes required for resubmission.
