Buffalo County board adopts resolution vacating portion of Evergreen Road

Buffalo County commissioners voted on Aug. 27 to vacate a 66-foot segment of Evergreen Road that runs between the South Right of Way at 235th Road and the North Right of Way line of 220th Road. The board adopted Resolution 2024-40 after considering a written recommendation from the Buffalo County Highway Superintendent and a prior public hearing held Aug. 13, 2024.
The resolution finds that the highway superintendent recommended vacation, that proper notice and publication requirements were met, and that no objections appeared at the earlier public hearing. As adopted, the resolution declares that one-half of each side of the former road will revert to the owners of adjacent real estate and that the vacation is subject to continued occupation by any public utilities that now occupy the right-of-way. The resolution references Sec. 39-1725, Revised Statutes of Nebraska, regarding required filings and indexing of the action.
The board recorded that the vacation shall be effective upon adjournment of the Aug. 27, 2024 meeting. The resolution directs county staff to file and index a copy of the resolution against affected parcels with the Register of Deeds.
