Buffalo County adopts 2024–25 One and Six Year Road and Bridge Plan; vacates portion of Evergreen Road

The Buffalo County Board on Sept. 10 adopted the 2024–25 One and Six Year Road and Bridge Plan after a public hearing in which Highway Superintendent John Maul presented the program and no members of the public addressed the Board.

Commissioner Ronald Loeffelholz moved to adopt the plan and Commissioner Timothy Higgins seconded; the Board approved the motion by roll-call vote. The minutes record the hearing opened at 10:29 A.M., closed at 10:37 A.M., and the plan was adopted as presented.

Separately, the Board voted to amend Resolution 2024-40 and adopt Resolution 2024-40A to vacate a 66-foot public road known as Evergreen Road between 220th Road and 235th Road. The amended resolution corrected the legal description for abutting parcels (identifying Government Lots 6, 7, 18 and 19 in Section 30) and states the Buffalo County Highway Superintendent recommended vacation. The resolution specifies that, after vacation, one-half of the former right-of-way on each side will revert to the owners of adjacent real estate, subject to continued occupation by any public utilities that now occupy the right-of-way. The vacation is effective upon adjournment of the Board’s Aug. 27, 2024 meeting as recorded in the minutes.

Highway Superintendent John Maul presented the study and written recommendation to the Board; commissioners cited the superintendent’s report in adopting the vacation resolution. The minutes note required publications and notice to adjoining landowners were made as required by state law.

The action updates county road planning and conveys affected title interests as described in Resolution 2024-40A.
