Buffalo County Board ratifies routine finances, sets hearings and defers Evergreen Road decision

The Buffalo County Board of Commissioners handled a range of routine administrative, financial and scheduling matters during its Aug. 13 meeting.
The Board approved meeting minutes from July 23 and ratified payroll claims for July 26 and Aug. 9, 2024. It accepted the County Treasurer’s July fund balance report and approved changes in pledged collateral at Nebraskaland Bank (add $1,200,000; release $1,000,000). The Board accepted the Clerk of the District Court report and the Buffalo County Sheriff’s and Treasurer’s Distress Warrant reports.
The board ratified several administrative items by roll-call votes (six 'Aye' votes; Commissioner Ivan Klein absent) including: - Emergency Protective Care (EPC) Agreement with Region 3 Behavioral Health Services for July 2024–June 2026 (approved). - Ratification of Chairperson’s signature on Kroger opiate settlement (approved). - Ratification of Vice Chairperson’s signature on the Annual Federal Funds Purchase Certification for NDOT (approved). - Ratification of a letter opposing sections 34–38 and 40–42 of LB 9 (approved).
During the Board of Equalization session, the Board approved motor vehicle tax exemptions: a 35% permissive exemption for Seneca Sunrise and renewals for Community Action Partnership of Mid-Nebraska and Evangelical Free Church of Kearney. The Board also accepted the 2024 Cemetery Report.
Highway Superintendent John Maul reviewed the One & Six Year Road and Bridge Program; the Board set a public hearing for Sept. 10, 2024 at 9:45 a.m. and authorized Vice Chairperson Morrow to sign the Annual Certification of Program Compliance (Resolution 2024-36) required by state statutes.
Facilities Director Stephen Gaasch presented current construction projects. The Board set a demolition bid date of Sept. 10, 2024 and later amended the timeline to state demolition is set to begin Nov. 12, 2024; Commissioner Timothy Higgins was appointed as the county representative for change order approvals (change orders approved by that representative will be ratified at the next Board meeting).
The Board opened a road vacation public hearing for a portion of Evergreen Road; residents Billy Dibbern and Dale Taubenheim spoke in favor. State statute prevented an immediate decision, so the Board moved to defer a decision to the Aug. 27, 2024 meeting. The motion to defer passed.
The Board went into executive session at 10:23 a.m. to discuss contract negotiations with legal counsel and staff present, then returned to open session at 10:42 a.m. No public action arising from the closed session was reported in the transcript. The meeting adjourned at 10:44 a.m.
