Buffalo County amends 1985 Poole Street vacation to clarify vacated right-of-way

The Buffalo County Board of Commissioners on Aug. 13 amended a 1985 resolution vacating portions of streets in the unincorporated Village of Poole to provide more precise legal descriptions and to file supporting survey and plat documents.

Vice Chairperson Sherry L. Morrow led discussion of proposed language that narrows the description of the vacated portions of "A" Street and North Avenue. County staff and counsel reviewed an "Official Buffalo County Dependent Resurvey" dated Jan. 6, 1986, by Deputy County Surveyor Lee W. Wells, and advised that the revised language aligns the 1985 action with later-surveyed records. The resolution directs that a certified copy of the amended resolution, the Wells survey, and the village plat be filed against the affected parcels in the Register of Deeds to effect the reversion of one-half of the vacated right-of-way to adjoining property owners as described under the law cited in the discussion (Sec. 39-1725, Neb. Rev. Stat.).

The amendment (Resolution 2024-37) passed on a roll-call vote with six 'Aye' votes; Commissioner Klein was absent. The resolution instructs county staff to file the revised language and supporting documents so that the vacated areas are described with the specificity the County Attorney’s Office recommended.

Next step: county staff will file the certified resolution, survey and plat as directed to ensure the legal descriptions are recorded with the Register of Deeds. The amendment does not appear to create new vacated areas beyond those discussed in the 1985 record; it clarifies the original action for recordkeeping and legal clarity.
