The Buffalo County Board of Commissioners on Feb. 13 adopted Resolution 2024-06 to vacate a 66-foot stretch of 39th Road running east–west between the east right-of-way of Odessa Road and the west right-of-way of Eagle Road.
The action follows a study and recommendation by the Buffalo County Highway Superintendent and a public hearing held Jan. 23, 2024 in which no objections were recorded. The resolution finds the road was originally opened by petitioner action in the 1880s and states that, except for continued occupation by existing public utilities, title or right-of-way will revert to adjacent property owners in equal halves along each side of the vacated area.
The resolution was moved by Commissioner Ron Loeffelholz and seconded by Commissioner Sherry Morrow and adopted by unanimous roll call. The resolution notes compliance with statutory notice requirements and specifies that the vacation becomes effective upon adjournment of the Feb. 13 meeting.
