Joint Murray–Lyon drainage board accepts DNR petition and appoints engineer for Judicial Ditch 27

At a joint meeting convened July 15, the Murray County Board sitting with Lyon County as the joint drainage authority accepted a petition filed by the Minnesota Department of Natural Resources to impound, reroute and divert waters on Judicial Ditch 27 for the purpose of wetland restoration.
The board found the petition conformed with the requirements of Minn. Stat. §103E.227 and, by motion of Commissioner Crowley seconded by Commissioner Zins, adopted findings and an order that appoints Bolton & Menk engineer Shaun Luker to investigate the proposed installation and file a report of findings with the Murray County Auditor. The motion passed on a recorded vote of five yeas, zero nays.
The order requires the engineer to take an oath, post a bond conditioned to cover damages resulting from negligence, and to diligently perform assigned duties. The board directed that the costs associated with the proceedings are the responsibility of the petitioners. Upon filing of the engineer’s report, the auditor will notify the board, which will set a hearing on the engineer’s report within 30 days and provide notice in accordance with Minn. Stat. §103E.261.
The findings and order were certified and filed by Murray County Auditor-Treasurer Heidi E. Winter on July 15, 2025. The joint action implements the statutory process for drainage petitions and advances the DNR’s restoration proposal to the engineering-review and hearing stages.
