Buffalo County approves Niemack administrative subdivision and authorizes development restriction for LOMR-F

The Buffalo County Board of Commissioners on Jan. 14 approved an administrative subdivision application filed on behalf of Gregory S. Niemack (MGNFT, L.L.C.) and adopted Resolution 2025-01 to accept the plat for recording. Chairperson Sherry L. Morrow opened a public hearing on the Niemack Administrative Subdivision; licensed land surveyor Mitch Humphrey presented the request and answered questions. No other members of the public addressed the Board before the hearing was closed and the resolution was adopted.
According to the resolution, the proposed Niemack Administrative Subdivision is located in the Agricultural (AG) zoning district and the plat meets the county’s subdivision resolution requirements and minimum lot-size standards; the record also notes that 70th Road is a county-maintained public road that abuts the subdivision and that title search paperwork was provided and cleared by the County Attorney’s Office. The resolution instructs that the plat be filed and recorded in the Office of the Register of Deeds, Buffalo County.
The Board also considered and approved a Building Restriction/Development Restriction Agreement related to a request for a Letter of Map Revision on the basis of fill (LOMR-F) for property in Bruner Lakeside Estates Second (legal description provided in the record). The county found that the LOMR-F submittal and engineer certifications satisfied local standards required for FEMA consideration and authorized Chairperson Morrow to execute the Development Restriction Agreement on behalf of the county. The action was adopted as Resolution 2025-02.
