Buffalo County adopts public records fee schedule in Resolution 2026-04

The resolution, which the board moved to approve (motion by Commissioner Ivan Klein, seconded by Commissioner Timothy Higgins), cites Neb. Rev. Stat. §§ 84-712–84-712.09 as authorizing recoupment of costs incurred in complying with requests. It directs county offices to treat requests uniformly, to require requestors to state whether they are Nebraska residents, non-residents, or news media, and allows the county to impose other fees permitted by law, including salary and legal fees when applicable.
The text also specifies that recordings of public meetings will follow the provisions of Resolution 2025-57 and that collected fees will be accounted for as public funds. The resolution will be filed with the Buffalo County Clerk and posted to the county website, according to the board’s action.
The motion carried on a unanimous roll-call vote; Commissioners present and voting "Aye" were Higgins, Kouba, Klein, Loeffelholz, Lynch, Maendele and Morrow.
The county clerk’s office will maintain the Cost Schedule and Public Records Request Form and make them available to the public.
