At its Oct. 16 meeting the Charlotte County Planning Commission directed staff to remove two ordinance provisions that conflicted with state law and tabled a separate question about tower setbacks.
Staff noted that Virginia Code § 15.2‑2316.4:2 prohibits localities from requiring applicants to submit propagation maps; the Commission agreed by consensus to delete the paragraph in Section 10‑9‑5 that required such maps. Commissioners also agreed to remove Section 10‑9‑10, which had required tower applicants to provide co‑location opportunities for county equipment; staff said state law prevents denial of an application on the basis of co‑location availability.
Commissioner Andrew Carwile asked whether the county should revise setback distances for telecommunications towers. The Commission gave no further direction on setbacks and agreed to table that issue for future discussion.
No formal ordinance was adopted at the Oct. 16 meeting; staff will fold the agreed deletions into the draft and proceed with legal review and the public hearing process.
