Brooke County commissioners approve ARPA draw for Hammond PSD, waive conflict in opioid suits and reject EMS monitor bids

The Brooke County Commission met in adjourned session Sept. 10, 2024, at the Courthouse and unanimously approved a set of routine consent items, including a $136,894.72 ARPA draw to fund Hammond Public Service District water system improvements and the signing of a Waiver of Conflict for the law firm Bailey & Wyant related to opioid litigation.
The meeting was called to order at 10:30 a.m. by President Andrew J. Thomas. Commissioners Stacey Wise and Thomas R. Diserio and Clerk Kimberly M. Barbetta were recorded as present. After preliminary formalities, the Commission approved the minutes from Sept. 3, 2024; Commissioner Diserio made the motion, Commissioner Thomas seconded and the motion passed unanimously.
Commissioners then approved Amended BHJ - ARPA Project #7 Draw #1 in the amount of $136,894.72 for the Hammond PSD Water System Improvements Project. The motion was made by Commissioner Diserio and seconded by Commissioner Wise and carried by a unanimous vote of the three commissioners present.
The Commission also approved a letter from Barbara McVicker requesting reopening of the Estate of Joseph George Marosi, Jr. to resolve bank issues; a Waiver of Conflict for Bailey & Wyant related to opioid litigation; and an affidavit submitted by Sheriff Richard E. Beatty, Jr. to the State of West Virginia reporting non-payment of taxes for the 2023 tax year totaling $330,264.17. Each of those motions was moved and seconded and passed unanimously.
Director Greg Moore of EMS/EMA notified the Commission of payroll corrections to remove two employees, Daniel Holmes and Amy Nickerson, from payroll records; the Commission accepted his notice to clean payroll records.
On procurement for emergency medical services, the Commission voted unanimously to reject all bids for six cardiac monitors after reviewing the proposals. Bids cited in the minutes were Zoll at $56,941.15 and Stryker at $263,014.98 without mounts (or $273,414.98 with mounts). The minutes state that the EMS monitors currently in service remain operational and can be serviced for approximately eight more years; commissioners thanked Director Moore for investigating the procurement.
The Commission approved invoices and vouchers and ordered checks across multiple county funds, including General County Fund checks 31661–31686 for $302,467.02; Coal Severance for $9,500.00; Dog Fund for $2,175.15; E911 Communication for $2,122.97; Ambulance for $2,517.69; Shelter Levy for $938.50; Valuation for $1,944.50; and Judicial Annex for $79.99.
With no further business, Commissioner Wise moved to adjourn and the Commission passed the motion unanimously. The minutes are signed by Andrew J. Thomas, President, and attested by Clerk Kimberly M. Barbetta.
