Charlevoix County planners to send comments to EGLE on CMS Energy wetlands permit for transformer work

Charlevoix County planners agreed Feb. 5 to forward comments to the Michigan Department of Environment, Great Lakes, and Energy (EGLE) on a CMS Energy permit application to excavate 185 cubic yards of wetland material in a 0.115-acre area and place clean fill for a mobile equipment pad for transformer replacement, plus a proposed culvert affecting 0.01 acre.

Planning Director Kiersten Stark presented maps and supplemental materials showing the site in Hayes Township and summarized that because the total wetland impact is less than one-third of an acre, EGLE had waived the requirement for mitigation. Commissioners discussed whether the gravel or spoils placed in the wetland for construction access would be removed after the work and whether the pad would be retained for future maintenance.

Pam Grassmick, via written comments provided to the commission, stated: "The application could have better described the rationale for the request. However, as it involves a transformer replacement necessary for the health, safety, and general welfare of the community, I find the application complete and have no further comments." After discussion, Matt Cunningham moved to send the commission’s comments to EGLE (an earlier motion to take no action was amended); Dave Wheeler supported the amended motion. Voice vote: all in favor.

Why it matters: the project would temporarily impact a small amount of wetland to maintain electrical infrastructure; the commission’s comments will be submitted to EGLE as part of the public notice process.
