During the session, Commissioner Munson moved and Commissioner Buckley seconded a motion to adjourn into executive session for “attorney consultation and negotiation strategy for ongoing litigation pursuant to NDCC 44-04-19.1(9).” The motion carried with all voting aye, and the executive session ran from 4:33 p.m. to 5:13 p.m., attended by commissioners from both counties, auditors, both counties’ sheriffs, Assistant States Attorneys Ingolo and Lingle, and Attorney King.
After the commission reconvened at 5:13 p.m., Commissioner Munson moved and Commissioner Nathan Boehm seconded a motion to approve a settlement of $260,000 with Oxentenko, Sherwin Williams & Comstock addressing a paint issue at the joint detention center. The motion carried with all voting aye.
The minutes record that Chairman Bittner then adjourned the joint meeting at 5:15 p.m.
