The Harrah City Council on Jan. 15 accepted the River Mist Phase 3 Final Plat with a condition that no permits be issued for lots located in the floodplain until the developer secures a Letter of Map Revision (LOMR).
Vice Mayor Steve Scalzo moved to accept the plat with the condition; Tim Rudek seconded. City Attorney Robert Thompson and City Engineer Bill Myers told Council the City would bear no liability with the U.S. Army Corps of Engineers, the U.S. Environmental Protection Agency or the Oklahoma Department of Environmental Quality so long as the City refrains from issuing permits for floodplain lots. The motion passed 4–1, with Councilmember Jennifer McCammond voting no.
Council members said the requirement effectively prevents the developer from advancing to Phase 4 of the project until the LOMR is completed. The council also noted that, with the plat acceptance, the City will not assume ownership of the streets or the stormwater system in Phase 3; the city will take ownership only of water and wastewater systems as specified in the staff report.
Council directed planning and engineering staff to track LOMR submission and withhold permits for any lots currently shown in the floodplain until the mapping revision is provided.
