Cowley County weighs moratorium to slow Evergy transmission-line routing; counselor warns of likely litigation

Cowley County commissioners on Feb. 3 discussed a letter from Evergy proposing an alternate route for a transmission line near county property and considered whether to pursue a moratorium to slow the routing process.
County Administrator Lucas Goff presented the Evergy letter and said the county could leverage the state’s windfarm moratorium approach to slow the process in areas of Cowley County affected by both proposals. Vice Chairman Alan Groom asked whether imposing a moratorium would likely lead to litigation. County Counselor Mark Krusor replied that there is a strong possibility of court action if a moratorium is passed. Goff suggested Cowley County could coordinate with neighboring Sumner and Sedgwick counties to increase leverage.
County officials did not take formal action on a moratorium at the meeting; minutes record the discussion and a caution from the county counselor about legal risk. The county instructed staff to continue monitoring Evergy’s routing proposals and to report back to the commission as appropriate.
