Midway Council adopts ordinance clarifying churches as conditional uses in RA-1-43 zone

The Midway City Council unanimously adopted Ordinance 2026-08 to amend Section 16.12.020.G of the Municipal Code and make churches a conditional use in the RA-1-43 (residential-agricultural) zone.
Planning Director Michael Henke said the change corrects contradictory code language that previously listed churches both as permitted and conditional uses in the same section. The proposed amendment ensures churches in RA-1-43 are processed as conditional use permit applications subject to Planning Commission and Council review.
Council Member Kevin Payne moved to adopt the ordinance; Council Member Andy Garland seconded. Mayor Craig Simons opened the public hearing but no public comment was offered. The Council voted in favor (Garland, Orme, Osborne, Payne, Simonsen — Aye).
Henke noted the Planning Commission had recommended the change. The ordinance makes the City’s treatment of churches consistent across residential zones and preserves the Council’s ability to impose conditions when a church is sited in the RA-1-43 district.
Mayor Craig Simons said he planned to write a letter to The Church of Jesus Christ of Latter-day Saints requesting Swiss architecture for the Michie Lane church and asked council members to sign.
