Midway Council approves conditional use permit for new LDS stake center on Michie Lane

The Midway City Council voted to approve a conditional use permit for The Church of Jesus Christ of Latter-day Saints to construct a stake center at 171 East Michie Lane in an R-1-15 zone.
Planning Director Michael Henke presented the application, telling the Council the project met setback and parking requirements but that the proposed steeple exceeded the city’s 70-foot height limit. He said the Planning Commission recommended approval with conditions, including engineering sign-off and dark-sky-compliant lighting.
Andrew Wealing of Uncommon Architecture, representing the applicant, said the building was shifted about 100 feet west to reduce impacts to a neighboring house and that the City Engineer had provided a preliminary review of proposed entrances. “We moved the building to move it away from the house on the east side of the property,” Wealing said.
During the public hearing, resident David Scott, who said he was a member of the church, voiced support: “People would be blessed by the building,” he said. Neighbor Doug Jones raised concerns about traffic and questioned whether a school had been considered for the remainder parcel; Henke said any school proposal would require a traffic study and full staff review.
Council Member Andy Garland moved to approve the CUP subject to engineering approval and several findings and conditions: compliance with code setbacks and parking; the steeple reduced to 70 feet measured from natural grade (the plans showed a 71-foot-2-inch steeple as proposed); all Michie Lane modifications approved by the City Engineer and paid for by the applicant; lighting that complies with Midway’s dark-sky requirements; and opaque fencing to shield headlights from nearby properties. Council Member Andrew Osborne seconded the motion. The Council voted in favor (Garland, Orme, Osborne, Payne, Simonsen — Aye).
The approval includes a recommendation that the applicant consider Swiss-style architecture, though the applicant declined to include Swiss features in the initial design. The Council’s approval is contingent on final engineering plans and any necessary plan revisions to ensure the steeple and other elements comply with the Municipal Code.
The Council’s action authorizes the applicant to proceed with final engineering and building plan submittals; the decision did not approve any subdivision or future development of the remainder parcel.
