The Willard City Planning Commission voted Feb. 19 to remove a condition that required annual testing of a private well tied to a short‑term rental permit.
Staff told the commission that the short‑term rental permit holder, identified in the record as Dan Gammon, had asked that Condition 5 — requiring annual water testing — be removed. Deputies confirmed with the Bear River Health Department and the State Division of Drinking Water that neither entity requires annual testing for private wells that do not serve a public water system. The city attorney and staff therefore recommended removing the permit condition.
Commissioners voted to remove Condition 5 by motion (Commissioner Bodily), seconded by Commissioner Dubovik; the motion passed unanimously. Fire and other safety conditions attached to the permit remain in force.
What happens next: The permitholder may proceed toward obtaining a business license and must continue to comply with remaining CUP conditions and applicable county/state requirements for private wells.
