Spencer County Fiscal Court approved changes to local residential zoning standards and granted a private rezoning request at its Sept. 8 meeting.
The court voted to approve the second reading of Ordinance No. 1 (FY 2021–22), which amends Article V of the Taylorsville-Spencer County Zoning Regulations. The ordinance updates dimensional requirements across residential districts (R-1, R-2, R-3 and RM), specifying minimum lot sizes, setbacks, building heights, parking and accessory-use rules. The amendments were presented by Mrs. Sweazy, who noted Planning & Zoning held a public hearing on July 1 and recommended the changes.
The ordinance text, as read into the record, includes: minimum lot sizes ranging from 7,200 sq. ft. (R-2 with sewer) to one acre (on-site septic), front and side yard setbacks (varied by district and sewer availability), maximum lot coverage, and accessory-use and signage restrictions. The court approved the second reading by roll call. A majority of magistrates supported the measure; votes were recorded at the meeting.
On a separate item, the court considered a rezoning petition filed by Anna F. Chesser on behalf of Darris Chesser for 2.49 acres at 235 Grays Run Road (Lots 15A & 16A Frank Young Division). After discussion, the court granted the zone change from AG-1 (agricultural) to R-3 (residential) based on the Planning & Zoning board’s findings of fact, including binding elements limiting development to a single-family dwelling on a permanent foundation with a front porch and a rear deck or patio. The final vote on the Grays Run Road request was 4–2 in favor (Esq. Travis, Esq. Brewer, Esq. Beaverson and Judge John Riley voted yes; Esq. J. Moody and Esq. M. Moody voted no).
The court also published notice of several first-reading zoning items to be considered at a Sept. 20 public hearing, including requests from MMS Land LLC, Webb/Riggs, Wolfe, Greenwell, Stevens, Whitaker and Sunrise Market LLC.
The ordinance language approved on second reading will be submitted for final adoption on the scheduled second-reading cycle unless additional filings or appeals change the timeline. The court’s minutes include the Planning & Zoning recommendation and the binding elements attached to the Grays Run approval.
