Spencer County Fiscal Court approved the second reading and adoption of Ordinance No. 4 (the revised Subdivision Regulations) at its Jan. 3 meeting.
The ordinance repeals the Revised Subdivision Ordinance of 1992 and sets updated standards for subdivision design, required improvements, bonding/surety for public improvements, street widths and drainage. The rule package references coordination with Kentucky Transportation Cabinet standards and requires performance sureties — letters of credit or bonds — for incomplete public improvements. The joint planning and zoning commission recommended the changes after a public hearing on Nov. 18, 2021, and the fiscal court approved them following the second reading.
The ordinance text details procedures for preliminary and final plat approval, construction-plan standards, inspection schedules, and measures for private roads and storm‑water management. The planning commission and county engineer retain roles in approving construction plans and accepting completed improvements.
What happens next: the ordinance is effective upon adoption; developers will be required to comply with the updated standards and posting requirements for performance sureties for incomplete improvements.
