Fayette County to include paid holidays when calculating overtime for non‑exempt employees
Summary
Human Resource Director Lewis Paterson asked the board to include paid holiday hours when computing overtime for non‑exempt employees; commissioners approved the change 5-0. Staff said the current practice follows the Fair Labor Standards Act but including holidays would better compensate employees working extra hours in holiday weeks.

On March 14 the Fayette County Board of Commissioners approved a change to overtime calculation policy that adds paid holiday hours to the hours used when determining overtime for non‑exempt employees.
Human Resource Director Lewis Paterson explained that overtime pay is currently based on hours actually worked above the FLSA threshold (40 hours per work week) and that paid holiday hours are not included in that calculation. Paterson said staff believed including holiday hours would more fairly compensate employees who work extended hours during weeks that contain county‑observed holidays. The Board approved the change by motion of Vice Chairman Edward Gibbons, seconded by Commissioner Charles W. Oddo; the vote was 5-0.
Context: the Fair Labor Standards Act (FLSA) permits employers to exclude paid time off from the overtime calculation; county staff described the proposed change as a local policy decision to provide additional compensation fairness rather than a federal mandate.
Next steps: staff will implement the payroll change for non‑exempt employees according to county procedures.
