Morgan County commissioners approve closure of portion of County Road 19 at CK2 property

The resolution says the closure is requested to "limit public access to reduce access to CK2’s properties and to avoid conflicts between public vehicle traffic and CK2’s CAFO operations" and authorizes CK2 and its invitees to continue accessing the closed portion of the roadway. It permits CK2 to install a gate provided the exact location and design are approved in advance by the Morgan County Public Works Department, and it requires that Morgan County and emergency services be provided a means to open the gate at will.
While the resolution is in effect the county will not be responsible for road maintenance on the closed portion; the document authorizes CK2 to conduct necessary maintenance to access its property. The resolution also states the closure shall not be deemed an abandonment or vacation of the road and that the board may reopen the closed portion at any time; if reopened, the property owner must remove any gate at its expense.
