Morgan County planning actions: Polar Block subdivision approved; Jess rezoning and EV charger rules adopted

Morgan County commissioners on Dec. 16 handled several planning and zoning matters: they conditionally approved the Polar Block four‑lot minor subdivision, approved a multi‑parcel rezoning application from Randall and Rhonda Jess to Agricultural Production, and adopted amendments addressing electric vehicle (EV) charging systems to comply with House Bill 24‑1173.

Planning Director Nicole Hay presented Resolution 2025 BCC 48 conditionally approving Polar Block Minor Subdivision with conditions that include a recorded covenant requiring Lots 1–3 to share private‑road maintenance costs, inclusion of Lots 1–3 into the Morgan County Quality Water District (demonstrated by recorded court inclusion order within six months or approval is void), and standard drainage and water disclaimers. The board approved the resolution 3–0.

The board also approved a rezoning request from Randall and Rhonda Jess to correct split‑zoning inconsistencies and convert several parcels to Agricultural Production; Planning staff and the Planning Commission recommended the change and the board voted 3–0 in favor.

Finally, the board adopted Resolution 2025 BCC 49 amending the county zoning regulations to add a definition for electric vehicle charging systems and to allow accessory EV charging systems by right in Light Industrial and Commercial zones and as accessories to specific uses (event centers, hotels, motels, restaurants and gas stations), satisfying requirements in HB24‑1173. The Planning Commission recommended the amendments on Dec. 8 and the board approved them 3–0 on Dec. 16.

All measures were approved with standard conditions; staff will follow up on recording covenants, water‑district inclusion documentation and required administrative permits for EV charger installations where applicable.
