Spencer County approves one-year lease with Bluegrass Fiber for tower space; one magistrate votes nay

Spencer County Fiscal Court voted Nov. 20 to enter a one-year lease with Bluegrass Fiber LLC for space on a county-owned guyed tower located at 843 Fairgrounds Road, Taylorsville, effective Dec. 1, 2023.
Under the lease, Bluegrass Fiber will pay residual monthly payments of $120, be responsible for installation costs for its equipment, maintain commercial general liability insurance (minimum $1,000,000 per occurrence, $2,000,000 aggregate) naming the county as an additional insured, and comply with applicable federal and state regulations, including limits on electromagnetic emissions. The lease contains standard clauses on interference, indemnity, and lessee obligations to obtain permits.
County staff presented the lease and answered procedural questions. The motion to enter the lease was made by Esq. Travis and seconded by Esq. Pharris; the court approved the lease by voice vote with all members present voting "aye" except Magistrate Esq. Cotton, who voted "nay." Magistrates discussed access, notice provisions, and lessee responsibility for any interference or hazardous-substance issues.
The lease term runs through Nov. 30, 2024, and automatically renews for successive one-year terms unless either party provides written notice at least 90 days before the end of the then-current term. The county will receive monthly payments and the lessee will pay for installation and ongoing maintenance of its equipment.
