Snowflake council approves two variances and a utility easement; rezoning request not recommended

The Snowflake Town Council on Sept. 6 approved two property setback variances and a private utility easement and declined to advance a rezoning request after the Planning & Zoning Commission failed to recommend approval.
The council first approved the consent agenda — which included minutes from Aug. 2 and Aug. 16, the August check register and FY22 budget adjustments — by motion from Cory Johnson and second from Greg Brimhall. The motion passed unanimously with councilmembers Kerry Ballard and Lora Jones absent.
Two separate variance requests were then approved. Gary Graham presented a request (parcel 202-41-072) to keep a front-yard carport that encroaches on the setback; the Planning & Zoning Commission had recommended approval and council approved the variance (motion by Greg Brimhall, seconded by JoAnne Guderian). The council noted it had received eight neighbor letters in support. "I'm glad to see the original house being preserved," Councilmember Greg Brimhall said during discussion.
A second variance (parcel 202-11-018) for Sandi and David Ferrell to modify setback requirements for a new garage was presented by David Ferrell. The Planning & Zoning Commission recommended approval and the council approved the request (motion by Cory Johnson, seconded by Lynn Johnson).
The council also approved a private utility easement request from Pointe Company to place private utility easements in public right-of-way. Brian Richards presented the item and the council approved the easement (motion by Joe Bjornn, seconded by Cory Johnson).
By contrast, a rezoning request for parcel 202-38-008B (listed on the agenda as Burk) to change zoning from R-1 to AG did not receive a recommendation from the Planning & Zoning Commission and was not advanced by council. Council and staff discussed concerns about spot zoning. "We don't want to do spot zoning; we discourage it," said Brian Richards, who noted the request had been opposed by a number of people at the P&Z meeting.
The meeting adjourned at 7:37 p.m.
