Lunenburg approves participation in proposed Kroger opioid settlement

The Lunenburg County Board of Supervisors voted 7–0 on July 11 to participate in the proposed nationwide settlement of opioid-related claims against Kroger and related entities and to authorize the county attorney and outside counsel to execute documents necessary to effectuate the county’s participation.
County Attorney Frank Rennie presented a resolution noting the county’s adoption of the Virginia Opioid Abatement Fund and the Settlement Allocation Memorandum of Understanding (the Virginia MOU). The resolution states that the Kroger settlement would be considered a “Settlement” subject to the Virginia MOU and administered and allocated like previous opioid settlements the county entered into with distributors and manufacturers.
The resolution’s preamble cites the toll the opioid epidemic has taken on state and local services and recommends participation to recover the county’s share of the settlement funds. Supervisor Mike Hankins moved to approve the resolution; Supervisor Edward Pennington seconded and the motion passed unanimously.
Why it matters: participating preserves the county’s ability to receive its portion of any settlement funds allocated through the Virginia MOU. The county directed counsel to execute releases and other documents needed to finalize participation.
