Grant County P&Z to mail permit reminder letters, will file floodplain paperwork under SB 2027

The Grant County Planning & Zoning Board voted Dec. 3 to have the P&Z director notify property owners about unpermitted structures and to file state paperwork needed after passage of Senate Bill 2027.
Chairman Robert Ternes called the meeting to order at 10:01 a.m. MST and the board approved the meeting agenda and the October minutes by unanimous votes. Jason Albert, Grant County P&Z director, told the board that Tax Director Steinmetz had identified non-permitted structures across several areas of the county, including the Rocks & Hills area, Trailer Area 2, the Schatz Subdivision and Red Rock Resort. The board directed Albert to write and mail reminder letters to the affected property owners informing them of their responsibility to apply for county building permits.
Albert also briefed the board on Senate Bill 2027, which the board discussed as a statutory change shifting floodplain management responsibility from townships to counties. Albert said Grant County already administers floodplain management and "will proceed with filing the correct paperwork with the North Dakota Department of Water Resources," a step the board approved as the administrative response to the state law change.
The board’s actions were procedural directives to staff rather than new local legislation: the decision to send letters is an administrative enforcement step, and the filing with ND DWR is an administrative filing to align county records with SB 2027. The board did not enact new permit fees or adopt a new ordinance during the meeting.
The board recorded that no building permits, utility permits or special-use/conditional permits were considered at this meeting. The meeting recessed at 10:50 a.m., reconvened at noon, and adjourned at 12:17 p.m.
The P&Z office will carry out the mailed notices and the ND DWR filing; Director Jason Albert said he will consult State's Attorney Walker for any needed legal clarification on enforcement scope.
