Fayette County OKs rezoning, subdivision change and updates right-of-way rules; transmits impact-fee amendment

The Fayette County Board of Commissioners approved several land-use and planning items at its June 27 meeting, including a rezoning request, a subdivision revision, a code amendment changing right-of-way donation rules, and transmission of a draft Capital Improvements Element (CIE) amendment for regional review.
Planning and Zoning Director Deborah Bell presented Petition No. 1348-24 to rezone 7.972 acres from Agricultural-Residential to Highway Commercial for future commercial development along State Route 85 and Price Road. Applicant Mark Wurster elected to proceed despite less than a full Board; the rezoning was approved 4-0.
Bell also presented Petition RDP-018-24 from Andrew and Catherine Mask to revise the Bakersfield Farms development plan to subdivide Lot 11 into two parcels; the applicant accepted the staff-recommended condition and the Board approved the revision 4-0.
On code amendments, Public Works Director Phil Mallon and County Attorney Dennis A. Davenport described Ordinance 2024-04 to revise when right-of-way donations can be required as a condition of development, including removing a property owner's ability to request a variance and narrowing when donations are sought; the ordinance passed 4-0.
Bell summarized a draft CIE amendment updating fire-protection projects through 2045 based on a consultant study; the Board approved transmitting the draft CIE to the Atlanta Regional Commission and the Georgia Department of Community Affairs for regional and state review (vote 4-0).
