Fiscal Court approves updated Estoppel Agreement to bar TIF in Henderson Industrial Park

Simpson County Fiscal Court voted Nov. 5 to approve an updated Estoppel Agreement that, as written, prevents a tax-increment financing (TIF) district from being implemented within the 450-acre Henderson Industrial Park.
County Attorney Sam Phillips told the court the change to the document clarified who the agreement covers by adding the words "together with its affiliates, successors and assigns." Phillips recommended approval because of that language change. The agreement will require the signature of County Judge/Executive Mason Barnes and also requires the signature of Mayor Larry Dixon.
The motion to approve passed by unanimous recorded vote. The Estoppel Agreement was presented as a legal safeguard limiting future use of TIF within the industrial park; the county did not adopt any new tax or spending measure in the action.
What happens next: Judge Barnes will sign the agreement and pursue Mayor Dixon’s signature; the agreement’s language will be part of the record for any future economic-development discussions involving the Henderson Industrial Park.
