County attorney asked to send letter to TDEC over alleged Dry Fork Creek Road dumping; county transmits concerns

The motion (Gary Binkley, seconded by Diana Pike Lovell) passed by roll-call vote 12-0. The meeting packet includes a letter dated Aug. 24, 2021, from County Attorney Michael B. Bligh to Commissioner David Salyers at TDEC. In the letter, Bligh explains that the county adopted a resolution asking the attorney to convey information about Division of Solid Waste Management enforcement matters concerning property owner Cory Brizendine.
The letter summarizes the owner’s account that the illegal dumping accumulated over many years by unknown persons without his consent and that steep topography makes removal or prevention impractical. The county commission states it believes the owner's explanations are accurate and asks TDEC to pursue a resolution that does not impose unreasonable or impossible compliance obligations on the property owner.
The motion and the attached letter are in the meeting packet; the board did not record further direction at the meeting. The letter was transmitted to TDEC and copied to the county commission and the county’s state legislators.
