Rhonda Nye seconded the motion but then withdrew her support; Markey then withdrew the motion as well.
After the withdrawals, commissioners agreed by consensus to forward the issue to county legal counsel for review and to bring it back for reconsideration at the next Board of Commissioners meeting. The meeting record does not show the county committing funds; the motion as introduced included the understanding that no costs would be assessed to the county.
Public comment earlier in the meeting included an appeal from Eric Van Dussen of Benzonia Township urging commissioners to review the underlying lawsuit before offering support. The board’s action at the meeting preserved the option to act later following a legal opinion.
