Commissioners rule Cherry Lane a private road after estate representative says family maintained it

The Ben Hill County Commission determined on June 8 that Cherry Lane is a private road after a public hearing in which an estate representative said the family maintained the roadway.
County Manager Michael Dinnerman opened the hearing by saying its purpose was to establish whether Cherry Lane is public or private and noted that the road had been functioning as a private roadway and maintained by the homeowner. Jay Whitley, representing the estate that maintained the road, said he had checked an RDC ArcView map that showed Cherry Lane as a road but clarified that the route had been private and maintained by his father. The transcript records that the homeowner had concreted the road and installed a mailbox at its end.
After hearing Whitley, the commissioners concluded Cherry Lane is private. Commissioner Bennie Calloway moved to close the public hearing and continue the regular meeting; Vice‑Chair Hope Harmon seconded the motion and the vote was unanimous among attending commissioners.
The commission then resumed its regular agenda. No additional public comments on Cherry Lane were recorded.
