Summary
A request to rezone 55.800 acres for a RaceTrac distribution warehouse was withdrawn May 22 after multiple motions to delay the hearing produced 2-2 ties; the petitioner said it will return to the Planning Commission to address resident commitments.
A request to rezone 55.800 acres from C-H (Highway Commercial) Conditional to M-1 (Light Industrial) for a proposed distribution warehouse was withdrawn by the applicant’s agent during the Fayette County Board of Commissioners meeting on May 22, 2025.
Steven Jones, the agent for the petitioner (RaceTrac Petroleum, Inc.; applicant Brent Holdings, LLC), asked the Board to table Petition 1360-24 to Aug. 28, 2025, saying the petitioner had met with adjacent residents and intended to engineer commitments in response to their concerns. Commissioners debated the request, and two separate motions to table the hearing failed on 2-2 votes because a full board was not present.
County Attorney Dennis A. Davenport explained procedural options, including withdrawing and refiling so the matter could return to the Planning Commission. After further discussion about the schedule and neighborhood outreach, Jones asked to withdraw the petition so the applicant could rework commitments and secure resident statements rather than return the neighbors to another public hearing.
Commissioner Charles W. Oddo moved to grant the withdrawal; Commissioner Charles D. Rousseau seconded. The motion passed 3-1 (Commissioner Eric K. Maxwell voted in opposition; Vice Chairman Edward Gibbons was absent). The Board therefore recorded the petition as withdrawn rather than holding the rezoning hearing.
The proposal had drawn neighbor concerns about traffic, site access and waste impacts at the intersection of N. Highway 85 and Corinth Road. Public commenters in the meeting’s comment period reiterated those worries and said they were not always aware of neighborhood meetings described by the agent.
The petitioner indicated it will return to the Planning Commission after revising plans and gathering written neighbor statements. No formal rezoning decision was made at the May 22 meeting.
