Autauga County clarifies which Town of Marbury plat roads it will maintain; declines to accept multiple streets

The commission accepted the following into the county road system where maintenance had previously been provided: Hunter Loop Road; Avenue G (now Autauga County Road 535); White City Road/Autauga Street (right-of-way obtained in Project SACP-377-4); and Weeks Loops Road (now Mushat Lane).
The resolution unequivocally denied requests to accept into the county road system those streets shown on the referenced plat that have not been maintained by Autauga County, specifically listing Avenue A, Avenue B, Avenue C, Avenue D, Avenue E, Avenue F, Park Street, Wilkerson Street, Russell Street, Rainer Street, Marbury Heights Road (noting an existing, different county-maintained Marbury Heights Road), Smith Street, and Mushat Street west of Hunter Loop Road.
The resolution cites Ala. Code §11-3-10 and Alabama Attorney General Opinion 2005-120 in framing the county’s authority and the fact-specific nature of determining whether a road becomes a public road. The county attorney was authorized to record the resolution and execute related documents.
The commission recorded the adoption of the resolution on the June 17 agenda; minutes show one abstention recorded in the resolution text (Jay Thompson abstained where shown in the resolution attestation block), but the minutes record motions related to the item as carried by a 4–0 vote with Thompson noted as abstain in the resolution document.
