Charles Mix County approves right-of-way agreement for Randall Community Water District pipeline

The Charles Mix County Board of Commissioners on July 18 adopted Resolution 2024-04 authorizing the Randall Community Water District to install a regional water transmissionline that will cross multiple county roads.

Brad Lawrence of Brosz Engineering presented the project and addressed county liability and roadway restoration concerns. The resolution requires the district to restore any roadway and ditch to "equal or better condition," to protect highway traffic during construction and maintenance, to repair any damage caused by a leak or related activity, and to meet crossing standards described in an attached letter agreement. The resolution also includes an indemnity provision to hold the county, its officers and employees harmless from claims arising from use or occupancy of the right-of-way.

Commissioner Nick Stotz moved to approve the resolution, Vice Chairman Colin Soukup seconded, and the board voted "all in favor; motion carried." The minutes record the board’s approval without recorded dissent. The board did not set additional conditions at this meeting beyond the provisions in the resolution.

The county’s action clears the way for the Randall Community Water District to proceed with permitting and construction coordination where the pipeline crosses county-managed roads. Implementation will be subject to the district meeting the standards and restoration obligations laid out in the adopted agreement.
