Supervisors table waiver request for letter of credit tied to Jaindl sewer improvements

Attorney David Backenstoe told the board that the Jaindl land development will require sewer-treatment-plant improvements managed by the Municipal Authority and that the Authority asked the township to waive the letter of credit that normally secures developer-required improvements.
Several supervisors expressed concern about waiving financial security while questions remain about the Municipal Authority’s loan and fiscal condition. "We are in the dark with regards to this project," said Supervisor Cindy Miller, urging that the Authority’s counsel and representatives attend the next meeting to explain agreements and financial obligations. Resident Paul Nikisher said the public is upset about the Authority’s conduct and asked what leverage the board has.
Backenstoe advised caution, saying the board is not obligated to grant a waiver and recommending the matter be discussed with Attorney Zator and Municipal Authority representatives present. The board voted to table the waiver until those parties can attend.
Next steps: the board asked that Mr. Jaindl’s counsel, a Municipal Authority representative and their attorney attend the next meeting so supervisors can better assess financial risk before deciding whether to waive the letter of credit.
