Madison County Board of Elections finds no change in recount of NC Supreme Court Seat 06; evidentiary hearing set for protest

The Madison County Board of Elections completed a recount on Nov. 20, 2024 of votes for North Carolina Supreme Court Associate Justice, Seat 06, and found no differences between the original results and the recount. The board met at the Beech Glen Community Center Gym in Mars Hill under procedures guided by the North Carolina State Board of Elections.
Director Jacob Ray reviewed North Carolina State Board of Elections Numbered Memo 2024-08, "Statewide Recount," as the procedural framework for the recount. The board recessed and reconvened multiple times during the process; minutes record motions to recess at 6:00 p.m. and reconvene the following morning, plus a separate recess and reconvening at 1:00 p.m., each motion passing unanimously as recorded (3-0).
After reviewing and signing the recount results, the board recorded that there were no differences between the original results and the recount for Seat 06. The board then held a preliminary consideration of a protest of voters submitted by Justice Jefferson Griffin. Following the preliminary consideration, the board voted to advance the protest to an evidentiary hearing and set that hearing for Monday, Dec. 2, 2024, at 4:00 p.m. The director was directed to secure a location for the hearing and to provide proper notice. All procedural motions documented in the minutes are recorded as passing unanimously (3-0).
The minutes list attendance for the meeting as Chair Jerry Wallin, Secretary Dyatt Smathers, members Brian Ball, Ray Lewis and Debbie Ponder, Director Jacob Ray, one public member, and precinct officials assisting with the recount. The meeting was called to order at 8:30 a.m. and adjourned at 2:30 p.m.
The evidentiary hearing is the next formal step on the protest submitted by Justice Jefferson Griffin; the board will provide meeting details once the director secures and notices a location.
