Catawba County approves easement updates with Terreva Catawba RNG for landfill gas pipeline and propane storage

Catawba County on Nov. 17 approved a package of easement documents with Terreva Catawba RNG, LLC related to the county's landfill gas program at the Blackburn Landfill.
Staff said the previously recorded pipeline utility easement (recorded Jan. 13, 2025) required termination because segments of the installed pipeline encroached beyond the recorded right‑of‑way. The parties presented an Easement Termination, a Temporary Pipeline Easement and a Temporary Easement Agreement that grants a 30‑foot pipeline right‑of‑way and a 20‑foot temporary workspace adjacent to the pipeline. The temporary easement is coterminous with the Landfill Gas Purchase Agreement and terminates automatically if the GPA expires or if the pipeline is abandoned or commercial activity ceases for 24 months.
Terreva, successor to MAS Catawba RNG, requested an additional temporary easement for a propane tank used to convert landfill gas to methane. Documents in the agenda packet include survey exhibits and metes‑and‑bounds descriptions of the easement area (per plats and exhibit attachments). The agreements permit ingress/egress, installation of related pipeline appurtenances, and allow Grantee to clear vegetation within the easement strip; they also require Grantee to pay reasonable damages for crops or fences directly affected by construction.
The Board approved the easement actions on the consent agenda. Signatory blocks in the packet identify Terreva's CEO and include notary language for execution; staff recommended recording the documents in the Catawba County Registry.
