Spencer County approves interlocal agreement allowing City to disconnect water for delinquent sewer accounts

Spencer County's Fiscal Court voted Dec. 1 to approve an Interlocal Cooperation Agreement with the City of Taylorsville and authorized submitting the agreement to the Kentucky Attorney General for review and approval.

The agreement, executed by the Spencer County Sanitation District and the City of Taylorsville, provides that after the District issues a final 30-day notice to delinquent customers, the District will give the City a list of properties for water disconnection; the City will disconnect water service and is to be compensated for turn-off and turn-on charges. The packet cites the Interlocal Act (KRS 65.210 et seq.) and KRS 220.510 as statutory authority for sanitation districts to coordinate water disconnection for unpaid sewer accounts.

The fiscal court adopted Resolution No. 11 approving the Interlocal Agreement and authorized submitting the agreement to the Attorney General for final review. County materials note the Department for Local Government reviewed the proposed agreement and recommended approval prior to Attorney General review.

Why it matters: The agreement creates an operational mechanism to collect delinquent sewer receipts by leveraging the municipality’s water disconnection authority and sets out administrative responsibilities, fees and remittance procedures between the District and the City.
