At the Fleming County Fiscal Court meeting on Aug. 13, resident Don Latham told the court that votes to discontinue maintenance of Denton Lane were conducted illegally and distributed a state statute to court members.
Latham said he attended to give the Fiscal Court an opportunity to rectify the decision even though his attorney advised him not to come to the meeting. The minutes record his statement but do not reflect a formal response from the court or any immediate action to reopen or revisit the prior vote.
Earlier in the minutes the court approved amendments to prior meeting minutes correcting the date of the last road maintenance on Denton Lane, actions recorded in separate motions. The court did not record any motion on Aug. 13 to rescind or formally reconsider the prior decision to discontinue maintenance.
The record shows the claim and the statute distributed by Latham were entered into the minutes; no hearing record of a legal determination appears in the Aug. 13 minutes.
