Mecosta County approves Tonkin Drain invoice, authorizes up to $10,000 for further legal counsel and tables censure resolution

The Mecosta County Board of Commissioners on July 3 approved an invoice for the Tonkin Drain project and authorized additional legal spending while postponing a proposed censure resolution concerning Drain Commissioner Karla Miller.
Commissioner William Routley moved to approve a Tonkin Drain invoice of $281,253.96; Commissioner Gary Lambrix seconded and the motion passed on a recorded vote. Later in the meeting the board entered closed session to consider a written attorney-client legal opinion on the Tonkin Drain matter. After returning from closed session, the board voted to table the resolution presented earlier by Chair Chris Zimmerman that sought nonsupport of the Tonkin Drain Project and censure of Drain Commissioner Karla Miller. The board then voted to seek further legal counsel on the Tonkin Drain issue and authorized up to $10,000 for that work.
During the public comment period several residents asked the county to join or support appeals and to provide records related to the Tonkin Drain bidding process; one commenter said he had submitted a FOIA request that had not yet been fulfilled. The board did not take formal action to join litigation during the July 3 meeting but did approve funding to obtain additional legal advice.
The motions to table the censure resolution and to authorize outside legal counsel passed; the board did not adopt the censure resolution at this meeting.
