Board adopts ordinance vacating part of alley in Town of Cuzco

At 9:30 a.m. the board held a public hearing on a petition to vacate part of a 10-foot public alley in the plat of the Town of Cuzco. Phil Buehler of Brosmer Land Surveying and Engineering, representing landowner Larry W. Sullivan, presented the petition and described the location and dimensions of the alley segment proposed for vacation.
After reviewing the petition and findings — including notice by publication and certified mail to the abutting owner, lack of utility locations, and a determination that the alley was undeveloped and not necessary for access — the board adopted Ordinance No. 2025-06. The ordinance vacates the described portion of the alley (containing approximately 0.034 acre), vests legal title equally in the adjacent property owner(s), and directs the Auditor to file the ordinance for recording. The ordinance provides a 30-day appeal period in the Circuit Court of Dubois County.
Commissioner Blessinger moved to approve the ordinance; the motion was seconded and carried. The ordinance takes effect immediately upon adoption as recorded in the minutes.
