Jasper County adopts property maintenance and public nuisance ordinance amendments

Jasper County commissioners voted Aug. 4 to adopt amendments to Chapter 12 of the county code that create Article I (property maintenance) and Article II (public nuisance buildings, dwellings or structures).
Planning and Zoning Director Doug Attaway said the P&Z board recommended the package by a 4–1 vote; member Bill Nash opposed specifically because he found language about outdoor storage (section 12-7) confusing. Gail Harrell, speaking on behalf of the City of Monticello, urged the county to allow the city to adopt the county language so magistrate court cases could be heard consistently, noting the city previously relied on county ordinances under an intergovernmental agreement.
County Attorney Adam Nelson said a city can adopt county ordinance language by reference and advised that the city’s legislative body must act to adopt the county’s code provisions; Nelson said the county would notify Monticello when ordinances change so the city could consider corresponding action.
Commissioner Steven Ledford moved and Commissioner Rob Alexander seconded approval of the ordinance amendment as presented; the motion passed unanimously. Commissioners asked the county attorney to reach out to Monticello’s attorney to clarify the adoption pathway for the city.
What happens next: the amendments take effect per county ordinance procedures; the county attorney will follow up with the City of Monticello’s counsel about adoption options and any needed clarifying edits to section 12-7.
