Union County commissioners declare District 3 seat vacant after evidence of relocation

The Union County Board of Commissioners voted on Oct. 29 to declare the District 3 commissioner office vacant after finding evidence that Commissioner Rich Headid had moved outside his district.
Motion by Commissioner Mike Dailey, seconded by Commissioner Peggy Ustad, carried 3–1 (Dailey, Ustad and Kevin Joffer voting yea; Tom Kimmel voting nay). The board said Headid provided a new address and that, based on the evidence and statutes cited in the record (SDCL 7-8-2 and SDCL 3-4-1), the office becomes vacant when a commissioner moves outside the district.
Headid addressed the board in open session and responded to commissioners’ questions before the vote. The minutes record that the board accepted documentation indicating a relocation on or about July 23, 2024; the transcript does not record an appointment or schedule for filling the vacancy.
The motion approving the vacancy was recorded in the meeting minutes; no further action to fill the seat was documented at the Oct. 29 meeting.
