County Counsel Paige Sully explained to the Lake County Board of Commissioners on May 20 that a parcel conveyed to the county carried retained mineral and right-of-way interests, likely boilerplate language from past conveyances.
Sully said the Albertsons are seeking a conservation easement and that the conservation trust wants the title cleared. She recommended the commissioners approve and sign an agreement to release the county’s retained interests. Sully noted that if the county later decided to mine or add roadways to the land it would need to seek permission under the released terms.
Why it matters: Clearing title or retained interests can be a prerequisite to conservation easements and conservation-trust funding; the action affects property rights and future county options.
What’s next: Commissioners were informed and action/consideration will occur in regular session.
